The purpose of this document (the “TOS”) is to deliver information about the eligibility verification system offered to you. These terms and conditions set forth a legally binding agreement governing your use of the system. By using the service, permitting any person to do so on your behalf or using the service on someone else’s behalf, you agree to these terms and conditions.
These terms are made effective as of the date of the initial eligibility verification request (“Batch”) submitted by you and accepted by us.
If you do not agree to these terms and conditions, you must discontinue your access to the site and not use the batch eligibility verification service. You agree to review the terms and conditions regularly and your continued access will mean that you agree to any changes.
These are the terms and conditions by which we will deliver and you will receive the services provided by HealingQuest. These terms are intended to cover any and all Services ordered by you and provided by HealingQuest, which are not explicitly covered by other agreements.
Descriptions of Common Terms throughout this Document
HealingQuest LLC, Boulder Emotional Wellness, and its third-party service providers are referred to as we, us and our throughout this document.
The individual that is using the services or products is referred to as you and your. You or an individual which you allow access to use the service or your source account is considered to be an Authorized User. Once you have signed and received our Business Associate Agreement, you are a “Business Associate” and have HIPAA responsibilities. A submitted list of Medicaid Identifiers made by you to be processed by us is a Batch.
Monday through Friday, excluding Federal Reserve holidays are Business Days.
Suitability
The products and services are offered to individuals and firms that are legitimately and currently enrolled in the Colorado Medicaid system and hold valid “Medicare Numbers” from HCPF.
Limited-Right License
You have the right to utilize the services exclusively for internal business purposes. You do not have the right to resell the service.
Term
The term of service is for the time from when your account is registered until you decide to no longer submit Batches, or if HealingQuest LLC terminates your service.
Fees and Payment Terms
You will pay all fees due according to the prices and terms indicated at the time of submitting a Batch. elig.pro uses Stripe as a payment processor. Click to read Stripe’s Service Agreement.
Intellectual Property Ownership and Usage
HealingQuest retains all rights, title, and interest in its technology and grants no transfer of intellectual property to Customer.
Limited Warranties
HealingQuest provides services on an “AS IS” basis. Customer acknowledges that Services may evolve over time, and HealingQuest disclaims warranties of merchantability and fitness for a particular purpose.
Customer Obligations
Customer must comply with all laws and is solely responsible for HIPAA compliance regarding the protection of the confidentiality of the uploaded and downloaded data. The Customer is responsible for the legality and integrity of their data and must adhere to anti-spam and service use restrictions. Breach of these warranties can result in service suspension or termination.
Liability
HealingQuest is not liable for delays or service interruptions outside its control and limits its liability to direct damages. Liability for indirect or consequential damages is disclaimed, and aggregate liability is capped as specified.
Termination
Users may terminate at any time by notifying support@elig.pro. No PHI is stored.
